Terms governing use of this website and purchases from Uncaged Ergonomics
These Terms & Conditions (“Terms”) govern your access to and use of uncagedergonomics.com (the “Site”), including purchases made through the Site. By accessing the Site, creating an account, submitting information, or placing an order, you agree to these Terms and the policies referenced below.

Please read these Terms carefully. They contain limitations of liability and a binding arbitration provision that may affect your legal rights and remedies.
Eligibility + customer accounts
Use the Site lawfully and keep account information accurate
Eligibility
You must be at least 18 years old, or the age of legal majority where you live, to create an account or enter into a purchase contract with us. Use of the Site is void where prohibited by law.
Account security
If you create an account, you are responsible for providing accurate information, maintaining the confidentiality of your login credentials, and promptly notifying us if you believe your account has been accessed without authorization.
Orders + payments
Placing an order does not guarantee acceptance
When you submit an order, you offer to purchase the selected products subject to these Terms. We may accept, reject, limit, or cancel an order as permitted by law, including because of inventory availability, payment issues, suspected fraud, pricing or product-information errors, shipping restrictions, or other operational reasons.
- Prices: prices, promotions, discounts, and availability may change without notice before an order is accepted.
- Errors: we may correct typographical, pricing, specification, availability, or other errors and may cancel an affected order when permitted by law.
- Payment: you authorize the applicable payment provider to charge the payment method submitted with your order, including applicable taxes, shipping charges, and other disclosed fees.
- Taxes: applicable sales, use, import, or other taxes may be collected or charged as required by law or by the sales channel used for the transaction.
- Order limits: we may limit quantities or decline orders that appear to be unauthorized resale, fraudulent, abusive, or otherwise inconsistent with our sales policies.
Product information
We work to keep product information accurate and current
We make reasonable efforts to describe products, specifications, dimensions, colors, features, compatibility, availability, and images accurately. Actual appearance can vary because of screen settings, manufacturing tolerances, product revisions, photography, and other factors.
Specifications + product changes
We may update product designs, materials, packaging, specifications, features, or components when doing so does not materially reduce the product's intended function, subject to applicable law.
Use + installation
You are responsible for reviewing and following the instructions, warnings, compatibility information, weight limits, electrical requirements, assembly procedures, and other guidance supplied with a product.

Separate policies apply to delivery, returns, and warranty service
Shipping + Returns
Order processing, free-shipping eligibility, delivery estimates, international charges, and return requirements are governed by our current Shipping & Returns policy.
Product Warranty
Warranty periods and coverage vary by product. The warranty stated on the applicable product page or written sales documentation and our Warranty policy govern warranty service.
If a product-specific written warranty, quote, invoice, or sales agreement contains terms that conflict with these general Terms for that transaction, the more specific written terms control to the extent of the conflict.
Acceptable use
Do not misuse the Site or interfere with other users
You may use the Site only for lawful purposes. You agree not to:
- Use the Site in violation of any applicable law, regulation, or third-party right.
- Attempt to gain unauthorized access to accounts, systems, networks, payment information, or non-public areas of the Site.
- Introduce viruses, malware, malicious code, or other technology intended to disrupt, damage, or compromise the Site or another system.
- Interfere with, disable, overload, scrape, probe, or circumvent the Site or its security features through unauthorized automated means.
- Use bots, crawlers, data-mining tools, or automated scripts to extract Site content except as permitted by us or by applicable law.
- Impersonate another person or entity, submit false information, or use another person's account without authorization.
- Submit unlawful, fraudulent, defamatory, threatening, abusive, obscene, infringing, deceptive, or malicious content.
- Collect personal information about others without authorization or send spam, unsolicited promotions, or other abusive communications through the Site.
- Use the Site in a manner that could harm Uncaged Ergonomics, our customers, our service providers, or other third parties.
We may suspend or terminate access to the Site when we reasonably believe these Terms have been violated or when necessary to protect the Site, customers, or our business.
Intellectual property
Site content and brand assets are protected
Unless otherwise indicated, the Site and its text, product copy, graphics, photographs, videos, logos, designs, software, interfaces, downloads, and other content are owned by or licensed to Uncaged Ergonomics and are protected by copyright, trademark, patent, trade-dress, and other intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Site for personal or legitimate business purchasing purposes. You may not reproduce, republish, modify, distribute, sell, license, frame, create derivative works from, or commercially exploit Site content without prior written permission, except where applicable law permits otherwise.
Uncaged Ergonomics names, logos, product names, graphics, and trade dress may not be used in a manner likely to cause confusion, imply endorsement, or suggest affiliation without written permission.
Reviews, feedback + submissions
You are responsible for content you submit
If you submit a review, photo, video, testimonial, comment, suggestion, idea, or other content (“User Content”), you represent that you have the right to provide it and that it does not violate law or another person's intellectual-property, privacy, publicity, or other rights.
By submitting User Content to us for publication or use, you grant Uncaged Ergonomics a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, reproduce, publish, display, distribute, adapt, and otherwise use that User Content in connection with our business, products, Site, customer support, and marketing, subject to applicable law and our Privacy Policy.
We may remove or decline to publish User Content that violates these Terms, is unlawful, is misleading, infringes rights, contains confidential information, or is otherwise inappropriate for the Site.

General disclaimer
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND SITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will always be uninterrupted, secure, error-free, current, or free from harmful components. Website availability can be affected by maintenance, internet conditions, software, carriers, hosting services, third-party systems, or events beyond our control.
These Site disclaimers do not replace any written product warranty or consumer right that cannot lawfully be excluded.
Limitation of liability
Limits on claims relating to use of the Site
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNCAGED ERGONOMICS AND ITS AFFILIATES, OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO USE OF THE SITE OR SITE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED $1,000.
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the limitations above may not apply to you. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Indemnification
Responsibility for misuse of the Site
To the extent permitted by law, you agree to indemnify and hold harmless Uncaged Ergonomics, its affiliates, owners, directors, officers, employees, contractors, agents, and service providers from claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising from your unlawful use of the Site, your User Content, your violation of these Terms, or your infringement of another person's rights.
Suspension + termination
We may protect the Site when misuse occurs
We may suspend, restrict, or terminate access to the Site or an account when reasonably necessary to investigate suspected fraud, prevent abuse, protect security, comply with law, enforce these Terms, or protect Uncaged Ergonomics or others. Provisions that by their nature should survive termination will remain in effect.
Governing law + dispute resolution

Governing law
These Terms and disputes arising from or relating to the Site are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles, except to the extent applicable consumer law requires otherwise.
Arbitration
To the extent enforceable under applicable law, you and Uncaged Ergonomics agree that disputes, controversies, or claims arising from or relating to these Terms or use of the Site will be resolved by binding arbitration in Morgantown, West Virginia under the applicable Consumer Arbitration Rules and procedures of the American Arbitration Association (“AAA”).
The arbitrator, rather than a judge or jury, will resolve the dispute and may award remedies permitted by applicable law and the governing arbitration rules. Arbitration is a final and binding process subject to the limited review permitted by law.

Court proceedings not subject to arbitration
For disputes or claims that are not subject to arbitration, the parties consent to the jurisdiction of the applicable state or federal courts in West Virginia, subject to any venue or jurisdiction rights that cannot be waived under applicable law.
Changes to these Terms
We may update these Terms as the Site and business change
We may revise these Terms from time to time to reflect changes to our Site, products, business practices, or legal requirements. The “Last updated” date at the top of this page identifies the most recent revision. Your continued use of the Site after revised Terms become effective constitutes acceptance to the extent permitted by law.
General provisions
Additional contract terms
- Entire agreement: these Terms and the policies incorporated by reference constitute the agreement governing use of the Site, except where a separate written agreement applies.
- Severability: if a provision is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
- No waiver: failure to enforce a provision does not waive our right to enforce it later.
- Assignment: you may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, subject to applicable law.
- Headings: headings are provided for convenience and do not change the meaning of these Terms.

Do these Terms also govern returns and warranties?
These Terms reference our separate Shipping & Returns and Warranty policies. Product-specific written warranty or transaction terms may also apply and can control when they are more specific.
Can an order be cancelled because of a pricing or inventory error?
We may correct errors and cancel or limit affected orders where permitted by law, including for incorrect pricing, inaccurate availability, payment issues, suspected fraud, or shipping restrictions.
Can I copy photos or product content from the website?
Site content is protected intellectual property. Commercial reproduction or redistribution requires written permission unless applicable law permits the use without permission.
Do the Terms contain an arbitration provision?
Yes. The current Terms provide for binding arbitration in Morgantown, West Virginia under applicable AAA Consumer Arbitration Rules to the extent the provision is enforceable under applicable law.
How will I know if the Terms change?
The revision date at the top of this page will be updated when these Terms are revised. Additional notice will be provided when required by applicable law.
